2. Description of the Software

BondMesh Command is an autonomous AI security analyst platform delivered as a cloud-based Software-as-a-Service. It ingests security signals from enterprise infrastructure, applies AI-driven reasoning to identify and classify threats, and executes autonomous response and remediation actions. The Software is currently in pre-commercial development and is made available to selected customers under Early Access terms.

3. Grant of Licence

Subject to your compliance with this EULA and any applicable Order Form or Early Access Agreement, BondMesh grants you a limited, non-exclusive, non-transferable, revocable licence to:

• Access and use the Software solely for your internal security operations purposes;
• Access the Software's API and interfaces as provided and documented by BondMesh;
• Use documentation and materials provided by BondMesh in connection with the Software.

This licence does not include any right to sublicense, resell, or distribute the Software or to use it to build competing products or services.

4. Licence Restrictions

You shall not, and shall not permit any third party to:

• Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works of the Software or any part thereof;
• Access the Software to build a product or service that competes with BondMesh Command;
• Use the Software to process data in violation of applicable law;
• Circumvent or disable any security, access control, or licensing mechanism within the Software;
• Remove, alter, or obscure any proprietary notices, labels, or marks on or within the Software;
• Use the Software in a manner that exceeds the scope of the licence granted in Section 3;
• Share access credentials with unauthorised parties;
• Use the Software in production critical infrastructure without BondMesh's prior written consent during the pre-commercial phase.

5. Ownership and Intellectual Property

The Software, including all underlying algorithms, AI models, source code, object code, documentation, and all intellectual property rights therein, is and remains the exclusive property of BondMesh DOO and its licensors. Nothing in this EULA transfers any ownership interest in the Software to you.

BondMesh retains all rights in the Software not expressly granted in this EULA.

6. Your Data

6.1 Licence to process

You grant BondMesh a limited licence to process data you submit to the Software ("Customer Data") solely to provide and improve the Software under this EULA and as described in our Privacy Policy.

6.2 Ownership

As between the parties, you retain all ownership rights in Customer Data. BondMesh does not claim ownership of Customer Data.

6.3 Anonymised data

BondMesh may use anonymised, aggregated, and de-identified data derived from the Software's operation to improve its products and the collective intelligence network, provided that no such data can be used to identify you or your organisation. This right survives termination of this EULA.

7. Feedback

If you provide BondMesh with feedback, bug reports, feature requests, or suggestions about the Software ("Feedback"), you grant BondMesh a perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, and incorporate such Feedback into the Software and related products without any obligation to you.

8. Third-Party Components

The Software may include or depend on third-party open source software components. Such components are licensed under their respective open source licences, which are made available upon request at [email protected]. BondMesh makes no representations or warranties regarding third-party components beyond those required by applicable law.

9. Updates and Modifications

BondMesh may update, modify, or discontinue features of the Software at any time and without prior notice, including during the pre-commercial phase. BondMesh will endeavour to provide reasonable notice of material changes that affect ongoing use. Updates are subject to this EULA unless accompanied by a new or amended agreement.

10. Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BONDMESH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

BONDMESH DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, FREE FROM VULNERABILITIES, OR THAT IT WILL DETECT OR PREVENT ALL SECURITY THREATS. CYBERSECURITY TECHNOLOGY CANNOT GUARANTEE COMPLETE PROTECTION AGAINST ALL THREATS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BONDMESH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR THE USE OF THE SOFTWARE, EVEN IF BONDMESH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BONDMESH'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS UNDER THIS EULA SHALL NOT EXCEED THE FEES PAID BY YOU TO BONDMESH IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR EUR 500, WHICHEVER IS GREATER.

NOTHING IN THIS EULA LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED BY APPLICABLE LAW.

12. Indemnification

You agree to defend, indemnify, and hold harmless BondMesh and its directors, employees, agents, and partners from any third-party claim, loss, liability, or expense (including reasonable legal fees) arising from: (a) your use of the Software in violation of this EULA; (b) your violation of any applicable law; or (c) your infringement of any third-party intellectual property or other rights.

13. Confidentiality

Each party agrees to keep confidential the other party's non-public information disclosed in connection with this EULA, including technical documentation, roadmaps, security architectures, and pricing. This obligation does not apply to information that: (a) is or becomes publicly known through no breach of this agreement; (b) was already known to the receiving party prior to disclosure; or (c) is required to be disclosed by applicable law or court order, provided notice is given where lawfully permissible.

14. Term and Termination

14.1 Term

This EULA is effective from the date you first access the Software and continues until terminated.

14.2 Termination by you

You may terminate this EULA at any time by ceasing all use of the Software and destroying any local copies of licensed materials.

14.3 Termination by BondMesh

BondMesh may terminate this EULA immediately upon written notice if you materially breach this EULA and fail to cure such breach within 14 days of written notice, or immediately for any breach that cannot be cured.

14.4 Effect of termination

Upon termination, all licences granted to you cease immediately. Sections 5, 7, 10, 11, 12, 13, 15, and 16 survive termination.

15. Export Controls

You agree to comply with all applicable export control laws and regulations, including those of the Republic of Serbia and the European Union. You represent that you are not located in, and will not use the Software in, a country subject to applicable trade sanctions, and that you are not on any denied-party list.

16. Governing Law and Disputes

This EULA is governed by the laws of the Republic of Serbia. Any dispute arising out of or relating to this EULA shall be resolved exclusively by the competent courts in Belgrade, Serbia. Where mandatory consumer protection law in your jurisdiction provides otherwise, those mandatory provisions shall apply.

17. General

• Entire agreement. This EULA, together with any applicable Order Form or Early Access Agreement, constitutes the entire agreement between the parties regarding the Software.
• Severability. If any provision of this EULA is held invalid or unenforceable, the remaining provisions shall continue in full force.
• Waiver. Failure by either party to enforce any provision of this EULA shall not constitute a waiver of future enforcement of that provision.
• Assignment. You may not assign this EULA or any rights hereunder without BondMesh's prior written consent. BondMesh may assign this EULA in connection with a merger, acquisition, or sale of assets.
• Notices. Notices to BondMesh should be sent to [email protected].
